ThinkData has a "No Return" policy on all
products that ship with source code. All sales are final.
Returns on downloaded software are generally only available only in those
unusual cases where you have made errors in entering your order or cases
of fraud. For this reason, you should download and test example software
prior to purchase. However we will examine each and every case individually.
For legal reasons, we must receive the Letter
of Intellectual Property Destruction as a hard copy, rather than an
electronic version through email. So, you will need a printer to complete
the rest of the return process.
You must adhere to the following guidelines:
1. All returns for downloaded software must be pre-authorized by ThinkData,
Inc. as described below. Your request for a Return Authorization Number
(described below) must be made to ThinkData within 30 days of the date
ThinkData made the software available to you by e-mail (the "Purchase
Date"), and ThinkData must receive, at its offices, your fully completed
and signed Letter of Intellectual Property Destruction. No refund will
be made until the Letter of Intellectual Property Destruction has been
received by ThinkData. ThinkData is not responsible for lost or misdirected
mail, delays for downloading, or other communication system delays. We
will not issue refunds on unauthorized returns.
2. Products not purchased directly from ThinkData must be returned to
the place of purchase and are subject to the return policies of the place
of purchase.
3. You must also destroy all copies of the software and/or the source
code you may have made or stored in any place, as well as uninstall the
software from any computers owned or controlled by you where you have
installed the software and/or the source code. Once you have returned
the Letter of Intellectual Property Destruction to ThinkData, all licenses
you may have to use the software will be immediately terminated, and any
further use of the software or any use of the source code or algorithms
derived from such source code will be an infringement of copyrights as
well as other intellectual property rights.
4. All Letters of Intellectual Property Destruction must have a Return
Authorization Number (RAN #) issued by ThinkData clearly displayed on
the form. To receive a RAN #, e-mail us at returns@thinkdata.com. You
must provide sufficient information for ThinkData to be able to identify
your transaction, such as the ThinkData order number and/or invoice number
and/or date of transaction given to you when the product was sent. If
ThinkData is able to identify your order, and the request is made within
the timeframe discussed above, you will be given a RAN # as well as a
copy of the Letter of Intellectual Property Destruction ready for completion
and return to ThinkData.
5. When making your request for an RAN#, please provide ThinkData with
your e-mail address if you can receive and print a document in Adobe Acrobat®
(or ".pdf") format. If you are not able to receive the form
by e-mail in a .pdf format, you must also provide us with a fax number
or mailing address to receive the form. You must fill out any missing
information on the Letter of Intellectual Property Destruction, sign and
date the Letter, and return it to ThinkData as instructed on the form.
When ThinkData receives your properly completed and signed Letter of
Intellectual Property Destruction and has approved the reason for return,
ThinkData, will provide a refund to you for the amount you paid for the
software.
